3. 법적 분석

일단 고소 자체는 진행할 수는 있어도 피고소인이 처벌받을 가능성은 낮을 것으로 보인다. 실제로 비판의 대상자가 사회적으로 물의를 일으켜 논란이 되었을 때, 흔히 말해 "욕먹을 짓을 했을 때"에는 고소인의 소송을 검사 측에서 불기소처분을 내리거나 아예 법원에서 기각시키는 일이 많다. 당연히 이는 국민의 표현의 자유를 보장하기 위함이다. 또한 풍자와 비판으로 본다면 허위사실이나 다른 법에 어긋날 정도가 아니면 법적으로 위배되지 않는다.

노무현 합성물을 만들면서도 긍정적이거나 중립적인 메세지를 담은 합성물이나 외국의 창작물일 경우에는 불명이다. 물론 이러한 경우는 고발하지 않겠지만, 대대적 고발을 자처한 주체들이 표현의 적절성에 대해 합리적인 기준을 과연 제시할 수 있는가에 대한 의문이 존재한다.[3] 판단은 법이 하더라도, 대규모 고소 협박만으로도 창작자들의 의지를 상당히 위축시킬 수도 있다.

실제로 교학사 노무현 합성 사진 수록 사건 당시 교학사 측에서 노무현 전 대통령의 비하 사진을 참고서에 실어 노무현의 아들 노건호와 노무현재단 측에서 해당 사건의 책임을 묻기 위해 교학사를 사자명예훼손 및 모욕 혐의로 교학사를 고소했으나 대한민국 경찰청에서 이를 무혐의 처리하여 해당 고소안을 기각시켰다. #. 또한 19대 대선 국면 당시 자유한국당의 유력한 대선 후보였던 홍준표는 19대 대선 국면에서 "뇌물 먹고 자살한 사람", "유죄 뜨면 노무현 대통령처럼 자살 검토하겠다" 등의 발언으로 노무현을 향해 대놓고 고인드립을 시전하자 이에 더불어민주당 측은 법적대응을 준비 중이라고 엄포를 놓았지만 끝내 고발하지 못했다. 이는 양 측 모두 국내법에 문제가 되는 부분이 전혀 없었기 때문이다.

다만 일부 해외 거주 제작자들은 유튜브 커뮤니티에 황희두를 대상으로 하는 원색적 욕설과 함께 고소해 보라는 등의 조롱을 날리기도 했다. 더욱이 MC무현물 자체가 이미 나온 지 10년도 더 지난 콘텐츠인지라 '지겨웠는데 이참에 노무현물 자체를 손절하겠다'며 관두는 유저들도 상당히 많아졌다. 그 외에도 노무현에게 우호적이었거나 그를 지지했었던 친노, 친문 성향의 지지자 내지는 반일베, 반디시 성향 등 고인드립을 부정적으로 보는 사람들 중에서는 '이런 조치를 취할 거였다면 10년 전, 아무리 못해도 문재인 정부 시절에 했어야 하는 거 아니냐? 왜 이제 와서 뒤늦은 조치를 하냐?'는 반응을 보이기도 했다. 상술하듯 너무 늦은 탓에 이미 별다른 정치 성향을 안 보이는 사람중에도 모르고 노무현 합성물이나 어록을[6] 쓰는 경우가 생긴 지 오래됐기 때문으로 보인다.

5.1. 사적검열 논란

해당 조치에 비판적인 커뮤니티[7]들은 유례없는 대한민국 대통령 합성물 고소라고 보고 있다.

그렇기에 기획고소를 검열의 일종인 사적 검열로 보는 데에는 무리가 없다고 비판한다.

위 근거에 따라 '노무현 합성물 고발이 '사적검열(private censorship)', 기획고소, 사찰, 캔슬 컬처 등에 들어갈 수 있다는 비판을 주장하고있다. 국가가 주체가 아닌 것만으로 인터넷 검열이 아니라고 보는 것에 반대하는 것이다.

이 사건은 합성 영상물은 아니고 포스터인데, 욱일기 바탕에 문재인 아버지의 친일행위 의혹을 적어놓은 것을 배포한 사람을 고소한 사건. 풍자물을 배포한 김정식 [11]은 피소되어 경찰에 열 차례 가까이 출두해 조사를 받았다. 김정식은 포렌식 때문에 자신의 휴대폰까지 3개월 가까이 압수당했으며, 조사 도중 경찰에 고소인이 누구냐고 묻자 누군지 알 거라 생각한다는 답을 들었다고 한다.[12] # 검찰은 문재인 전 대통령이 모욕죄 고소를 취하하라고 지시한지 8일만인 5월 12일에 김정식에 대해 불기소 처분했다.#
국민의힘 윤석열 합성물 탄압 논란 (2024)
윤석열 대통령 합성물 제작자가 명예훼손으로 고발된 사건. 경찰은 작성자 ID를 특정하기 위해 압수수색 영장을 집행했고 대통령 명예훼손 의도가 있었는지, 계속 비방하는 동영상을 제작하는 이유가 무엇인지 등을 추궁했다. ## 이후 제작자 5명이 검찰이 송치됐다. #

노무현 전 대통령 합성 영상은 양이 방대해 릴스 유포자들까지 조사할 가능성은 낮지만, 만약 유포자들도 조사를 받는다면 강도 높은 조사를 받을 수 있다. 방심위가 확산을 막아야 하는 유해 영상이라고 삭제 목록 공개를 거부했다고 나오기 때문에 # 몇 개의 영상이 대상이었는지 알 수가 없어서 자세한 전망은 어렵다. 기사에 오픈넷이라는 사단법인이 비공개 결정에 이의신청을 냈다고 하는데 결과를 알리는 기사가 없다.
